AfriForum welcomes decision against illegal development in Klerksdorp – now awaits municipality’s action
AfriForum welcomes the decision of the Appellate Authority of the Matlosana Local Municipality which on 30 October dismissed the appeal of Molau Shady Rammala of Bageso Housing and Development Consultants. The appeal was dismissed because, among other things, the developer in question was not the “competent and authorised agent of the owner of the land” – a core requirement in terms of Section 45(1)(b) of the Spatial Planning and Land Use Management Act.
The Appellate Authority found that Bageso Housing and Development Consultants, which attempted to commence the Hillview development in Klerksdorp, was not competent to do so as the company was already in final deregistration. This means that there was no legal entity that could submit the application or act on behalf of the owner.
AfriForum views this ruling as a victory for the community and the rule of law. The ruling emphasises that developers cannot develop land without proper authorisation and in breach of legislation.
“This case clearly shows that AfriForum’s involvement in spatial planning and land development matters is of critical importance. We will not allow illegal developments to continue without proper processes and public participation,” says Alta Pretorius, AfriForum’s District Coordinator for the Mooi River and surrounding areas.
AfriForum has already officially warned the Matlosana Municipality to stop the illegal development and is currently awaiting feedback. If the Municipality does not act within a reasonable period, AfriForum will consider taking further legal action to enforce the ruling and protect the community’s interests.
“We are not against development – we are against disorder and abuse of power. When developers rush ahead without the necessary approval, communities become the victims. We will ensure that this decision is respected,” says Pretorius.
